Victorious Process

The law firm leads many procedures before the Supreme Court brought forth forcefully prosecuting complaints of cassation. The team of lawyers specializing in handling court disputes, which are overseen by Prof. Adam Brzozowski as well as Prof. Wojciech Kocot,  presently leads the case of Glass Industry in Poland SA (as the defendant).

The underlying complaint against our client is the claim of redemption from art. 231 § 1 KC.  The composition of three judges from the Supreme Court, for the case, because of the newly created legal issues awakening serious doubts, decided to return to the composition of seven judges of the Supreme Court to clear-up the situation. The composition of seven judges, first agreed to the examination of the legal issues, and then decided to identify the case themselves.

Ultimately, in accordance with our decision, the verdict of the Appeals Court was repealed, and the case was given a following analysis. The achievement of this is relevant in such a way that this case returned to trial before the Supreme Courts, thereupon cassation complaints of our clients. Even though victory was obtained in the first and second instances, the Supreme Court first avoided a favorable verdict for our client, after accused by the prosecutor. From the succeeding verdict of the Appeals Court, the complying prosecution remained again, this time by our client, regarding the cassation complaint, which ended in a memorable win.
